TERMS OF SERVICE & PRIVACY POLICY

tl;dr

Yeah, I get it. You're tired of reading these stupid Terms of Service/Privacy Policy pages. I mean... these show up everywhere. Originally for this site, I wasn't gonna add one, but now that we added a shop... we kinda have to add these pages now.

So here's the takeaway from all of this: I don't care about your data in the slightest.

Well... that's a lie. I mainly use the shop as a means to sell my work online, but also to determine what people are interested in buying, and customize my projects based off of what people like or dislike.

The accounts you create are really only used for buying the products in the store (and I guess for responding to the blog posts). I don't care about how old you are, or where you live. In fact... I shouldn't know where you live, cause all of the products are digital, therefore even if I DID know where you lived, I don't care at all and will not use that information in the slightest.

With that being said, if you use your account to post derogatory comments on blog posts, make an excessive amount of purchases in the shop, buy an unreasonable and/or excessive amount of items, or attempt to manipulate the website to cause a chargeback, I have the right to terminate your account and/or block your usage of our services, aka the blog posts and the store, without warning.

Occasionally, I may update this website without warning, although that scenario is extremely unlikely, as I will notify any changes to this website through my Twitter page, and on my Discord server. If a change is made to the site and I failed to give any notice, that's on me, in which case you are free to yell at me until I send out the notification.

If you encounter any problems while using this site, please use the Contact form, or email me at tristan.gaylord7@gmail.com . I wanna work things out with you instead of leaving you on hold.

Alright, time for the legal stuff. Any of my notes will be marked with a blue background.

By using this website, you acknowledge that we receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet (no we don't.); login (for some reason we collect this, but only the last date you logged in); e-mail address (used to send emails in the case of an error or me having to yell at you to stop buying everything); password (Wix collects it, not me); computer and connection information and purchase history (I get sent an email whenever you purchase something. I do not get computer or connection information). We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page (Really, the only info I care about is how many people visit the page, and attempting to decrease loading times.). We also collect personally identifiable information (including name, email, password (nope), communications (unless we find a way to allow people to add phone numbers, we will only email you.); payment details (including credit card information), comments (off by default), feedback, product reviews, recommendations (god I hope this isn't a thing), and personal profile.

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address (Not true. All of my sales are digital only, so there's no need to collect a physical address. Name and email address are just for contact purposes). Your personal information will be used for the specific reasons stated above only.

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;

  5. To comply with any applicable laws and regulations (because apparently my tl:dr isn't acceptable).

Our company (this isn't really a company, more like a personal website) is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail (Who even sends customer support messages through postal mail?!? We will contact you by email only, because that's the easiest way to communicate).

If you don’t want us to process your data anymore, please contact us at [tristan.gaylord7@gmail.com]. (There used to be a second part about sending us mail to my physical address, but we deleted it because I don't want people knowing where I live.)

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. (All updates to the Privacy Policy will be made apparent underneath the appropriate update section on the Patch Notes. You can view all of the Patch Notes here .)

If you would like to: access, correct, amend or delete any personal information we have about you, you are invited to contact us at [tristan.gaylord7@gmail.com]. (Unless you've done everything correctly, there's nothing to worry about.)
